5. Royalty internship program. An orientation and training program for auditors and accountants of extractive strains to familiarize tribal workers with laws, procedures and royalty techniques. This program is recommended for strains that are considering a self-management agreement but have not yet acquired expertise in mineral revenue through a cooperation agreement within the meaning of FogRMA Section 202, as defined in FOGRMA and the thought provisions in paragraph 30 CFR 228.4. In addition, the federal Highway Indian Reservation Roads (IRR) allocation was taken over by the Agency in 2007 to increase responsibility for the management of self-management. Additional functions of the IRR program include new mandatory reporting requirements for calculating transportation project costs and processing transportation costs. The office is responsible for the implementation of the Tribal Self-Governance Act, the Indian Self-Determination and Education Assistance Act (P.L. 93-638) and the Joint Funding Simplification Act (P.L. 95-510) as a link to India`s self-determination. It develops and implements rules, policies and guidelines in support of self-management initiatives; facilitate the negotiation of annual financing agreements with eligible tribes and consortia; coordinates the collection of data on tribal budgets and performance on self-governance; and solves the problems identified during the financial audit and audits of self-governance operations. Under Section 403 (k) of the Act, funding agreements cannot include programs, services, functions or activities that are by nature federal or for which the status establishing the existing program does not permit the type of participation the tribe wants.
However, it is not necessary to identify a strain (or tribe) in the licensing statutes for a program or item to be included in a self-management agreement. While there are general legal and policy guidelines on what a federal function is, non-BIA offices will determine on a case-by-case basis, taking into account all the circumstances, whether a given function is federal on a case-by-case basis. In cases where the tribe disagrees with the Bureau`s determination, the tribe may request further review by the secretary. When a base/consortium decides to resume the operation of an OST program, the new funding for the implementation of this program would come from the OST-Dollar program. The new way the OST program operates will be reflected in the tribe`s GSO funding agreement.
